1. Introduction

   • Welcome to Coastal Setup. By renting beach equipment from Coastal Setup, you agree to comply with and be bound by the following terms of use. If you do not agree with any part of these terms, you may not rent our equipment.​

2. Rental Agreement

   • By renting equipment from Coastal Setup, you acknowledge and agree to the following terms:

3. Liability for Personal Injuries

   • Coastal Setup is not liable for any personal injuries sustained by the customer or any third party during the use of the rented equipment. Customers assume full responsibility for any risks associated with the use of the rented items, including, but not limited to, physical injuries, medical conditions, or accidents.

4. Responsibility for Damage, Loss, or Theft

   • Customers are responsible for the care and security of the rented equipment. In the event of damage, loss, or theft of any rented item, the customer agrees to pay for the repair or replacement of the item at the current market value.

5. Equipment Condition and Inspection

   • Customers are encouraged to inspect all rented equipment upon receipt and notify Coastal Setup of any existing damage or defects. By taking possession of the equipment, the customer acknowledges that it is in good working condition and free from any noticeable defects.

6. Return of Equipment

   • All rented equipment must be returned in the same condition as it was provided, normal wear and tear excepted, by the agreed-upon return time. Failure to return the equipment on time may result in additional rental charges.

7. Prohibited Uses

   • Customers agree not to use the rented equipment for any illegal or unsafe activities. Coastal Setup reserves the right to terminate the rental agreement immediately if the equipment is used inappropriately or dangerously.

8. Indemnification

   • The customer agrees to indemnify and hold Coastal Setup, its employees, and agents harmless from any and all claims, actions, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to the
     customer's use of the rented equipment.

9. Limitation of Liability

   • Coastal Setup shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising out of or in connection with the rental of equipment, even if advised of the possibility of such damages.

10. Governing Law

    • These terms and conditions shall be governed by and construed in accordance with the laws of the state of New Jersey, without regard to its conflict of law principles.

11. Severability

    • If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Amendments

    • Coastal Setup reserves the right to modify these terms at any time. Customers will be notified of any changes, and continued use of our services constitutes acceptance of the modified terms.
